Probate is the process also known as “estate administration”, where the court determines how your assets will be distributed.  Before your estate can pass to your children, the court needs to settle your debts, establish clear title to everything you own and then distribute your assets according to your will.  The probate process takes time and money.   Your estate will go through probate whether or not you have a will.
